Welcome to Next-Gen Tutor. By accessing or using our website at nextgentutor.ai and our AI-powered English tutoring service, you agree to be bound by these Terms of Service.

1. Description of Service

Next-Gen Tutor provides an AI-powered English language practice platform designed for professionals. Our service includes:

  • Real-time conversational practice with AI avatars
  • Automated performance assessment and feedback
  • Progress tracking and learning analytics
  • Certificate generation upon completion of milestones

2. Account Registration

To use our service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised use of your account
  • Accept responsibility for all activity that occurs under your account

3. Subscription Plans and Payment

  • Access to tutoring sessions requires an active subscription plan.
  • Free plans may be available with limited features.
  • Paid subscriptions are billed according to the plan selected (monthly or annually).
  • Payments are processed securely through Stripe.
  • You may cancel your subscription at any time through your account settings or the Stripe billing portal.

4. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the service
  • Interfere with or disrupt the service or servers
  • Use automated tools to access the service (bots, scrapers, etc.)
  • Share your account credentials with third parties
  • Use the service to generate or distribute harmful, abusive, or inappropriate content

5. Intellectual Property

All content, features, and functionality of the Next-Gen Tutor platform — including but not limited to text, graphics, logos, software, and AI-generated feedback — are owned by Next-Gen Tutor and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6. AI-Generated Content Disclaimer

Our service uses artificial intelligence to provide language tutoring and feedback. While we strive for accuracy:

  • AI-generated feedback and assessments are provided for educational purposes and should not be considered as professional language certification.
  • Scores and level suggestions are indicative and may not correspond exactly to official CEFR assessments.
  • We continuously improve our AI models but cannot guarantee error-free output.

7. Session Data

By using our service, you consent to the recording and analysis of your tutoring sessions for the purpose of providing feedback, tracking progress, and improving our service. Session transcripts and audio may be processed by third-party AI services as described in our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law, Next-Gen Tutor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid for the service in the twelve (12) months preceding the claim.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the service. We reserve the right to modify, suspend, or discontinue any aspect of the service with reasonable notice.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the use of our service shall be resolved through good-faith negotiation before pursuing formal legal action.

12. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via email or through a notice on our website. Continued use of the service after changes constitutes acceptance of the updated Terms.
